The notions of individual and collective ethics were first explicitly defined in the biostatistical literature in 1971 to motivate a mathematical solution to a posed ethical dilemma. This paper reviews key antecedents to these concepts and traces explicit references to them over time, primarily in the biostatistical literature. Following a historical exposition of these texts, a critical thematic analysis shows the following: the normative force of these concepts has not been adequately argued. Individual and collective ethics do not solve the (...) problem of how to use accumulating data to inform ethical action. The notions of the "individual" and the "collective" are too vague to prompt clear moral imperatives, especially in difficult cases. These concepts have not been successfully linked to a standard ethical framework. Finally, the paper concludes with the observation that a systematic, comprehensive ethical framework must be identified to fulfill the intuitions behind individual and collective ethics. (shrink)

Randomized controlled trial trial designs exist on an explanatory-pragmatic spectrum, depending on the degree to which a study aims to address a question of efficacy or effectiveness. As conceptualized by Schwartz and Lellouch in 1967, an explanatory approach to trial design emphasizes hypothesis testing about the mechanisms of action of treatments under ideal conditions, whereas a pragmatic approach emphasizes testing effectiveness of two or more available treatments in real-world conditions. Interest in, and the number of, pragmatic trials has grown (...) substantially in recent years, with increased recognition by funders and stakeholders worldwide of the need for credible evidence to inform clinical decision-making. This increase has been accompanied by the onset of learning healthcare systems, as well as an increasing focus on patient-oriented research. However, pragmatic trials have ethical challenges that have not yet been identified or adequately characterized. The present study aims to explore the views of key stakeholders with respect to ethical issues raised by the design and conduct of pragmatic trials. It is embedded within a large, four-year project that seeks to develop guidance for the ethical design and conduct of pragmatic trials. As a first step, this study will address important gaps in the current empirical literature with respect to identifying a comprehensive range of ethical issues arising from the design and conduct of pragmatic trials. By opening up a broad range of topics for consideration within our parallel ethical analysis, we will extend the current debate, which has largely emphasized issues of consent, to the range of ethical considerations that may flow from specific design choices. Semi-structured interviews with key stakeholders, across multiple jurisdictions, identified based on their known experience and/or expertise with pragmatic trials. We expect that the study outputs will be of interest to a wide range of knowledge users including trialists, ethicists, research ethics committees, journal editors, regulators, healthcare policymakers, research funders and patient groups. Little is known about how ethical organizational contexts influence employees’ perceived stress levels and well-being. This study used two theoretical lenses, ethical impact theory (Promislo et al. in Handbook of Unethical Work Behavior, M.E. Sharpe, Armonk, 2013) and ethical decision-making theory (Schwartz in J Bus Ethics 139(4): 755–776, 2016), to investigate the relationships among perceived organizational ethics (comprised of ethical climate, leader/manager ethics, and corporate social responsibility), work-related stress, and employee well-being (comprised of vitality, life satisfaction, personal growth initiative, (...) flourishing, positive mental health, and self-actualization). Findings across two studies indicated that organizational ethics was negatively related to work-related stress, and that work-related stress was negatively related to employee well-being. Perceived organizational ethics is positively related to employee well-being, with post hoc mediation tests indicating that work-related stress partially mediates this relationship. Our findings suggest that organizations should be proactive in improving their ethical climate, such as choosing ethical leaders, developing a robust and well-communicated code of ethics, and actively practicing CSR. These measures should reduce excessive work-related stress and improve employee well-being. (shrink)

How are the teachings of a thirteenth-century master relevant today? Twenty contemporary writers unpack Dogen's words and show how we can still find meaning in his teachings. Engaging Dogen's Zen is a practice oriented study of Shushogi (a canonical distillation of Dogen's thought used as a primer in the Soto School of Zen) and Fukanzazengi (Dogen's essential text on the practice of "just sitting," a text recited daily in the Soto School of Zen). It is also a study of the (...) entire self. Here, the principles of Soto Zen practice are unpacked and explained by leading contemporary Buddhists from the living tradition--monks, priests, academics, and community teachers. Tackling Dogen's approach to key issues, such as the preeminence of shikantaza, universal buddha nature, and what it means to be a Mahayana Buddhist, the contributors to the volume help Zen practitioners and any who are trying to deepen their lives to appreciate better the teachings of Soto Zen and make these teachings part of their lives. By revisiting what remains precious in Shushogi and Fukanzazengi, we let them breathe just as we learn to breathe in zazen. This investigation examines several key factors believed to promote human flourishing, specifically: Factor 1: Age, Education, & Healthcare, Factor 2: Labor Force Participation, Factor 3: Crime, Factor 4: Income, Factor 5: Youth Unemployment and Factor 6: Voting Behavior. Data was examined at the county level, and collected from a variety of US government and non-governmental organizations. Our investigation into the conditions necessary to promote human flourishing uses internal migration within the United States as the indicator of “unhappy” communities. The findings (...) reveal that all factors are important in emigration somewhere, but the factors vary for different counties. As a result, attempts to address the ills of society require an appreciation of geography and context. (shrink)

In Stig Hjarvard’s characterization, mediatization studies move beyond the positivist origins of the social sciences, as they must in order to avoid the fundamental contradiction between original commitments to classical determinism vis-à-vis human agency as acknowledged within mediatization studies. In order to sustain and enhance Hjarvard’s vision of the coherence between human agency and mediatization studies as a species of social science, I first sharpen these theoretical tensions by developing a robust account of human freedom as informed by Kant and (...) virtue ethics. I then adopt precise understandings of complementarity and epistemological pluralism as initially developed in Quantum Mechanics and subsequently by Karen Barad and Judith Simon as frameworks that can coherently conjoin contemporary social science with strong accounts of human freedom. The resulting coherency—or entanglement—between ethics and science implies new ethical responsibilities for social scientists as ‘virtuous agents’. (shrink)

When phenomenological descriptions of perceptual experience are given it often seems that the distinction between mode and content of perceptual experience is not given the attention it deserves and that consequently certain philosophical difficulties develop which might have been avoided. While it will no doubt be admitted that the distinction between the “how” and the “what” of appearing is of importance in the phenomenology of perception, at first sight the making of such a distinction may seem so simple as to (...) be hardly worth discussing. It may seem to involve a mere matter of distinguishing modifiers of the verb “to perceive” from this verb's direct objects and their modifiers, but further consideration shows the situation is not that simple. In some cases there are alternative ways of phenomenological description such that what one description seems to indicate to be content is what the other description seems to indicate to be mode, and yet the two descriptions are seen to be equivalent in intent. If we analyze one expression in accordance with its grammar then the alternative expression must be considered idiomatic, that is, not analyzable in accordance with its grammar, for otherwise the two expressions could not be considered compatible. Shortly after X-ray technology was discovered, it was utilized in war medicine. In this paper, the authors consider how the challenging context of war created fertile conditions for learning, as early radiologists were forced to find solutions to the unique problems posed during wartime. The “battlefield” became the “classroom” where radiologists constructed knowledge in X-ray instrumentation, methods, and education, as well as in medicine generally. Through an examination of two broad historical wartime examples, the authors illustrate how X-rays were used (...) as part of war medicine and offer a detailed sketch of instances of knowledge construction in war radiology. With a sociology of knowledge perspective, they conclude that the knowledge generated in war belongs also to civilian medicine. An understanding of war radiology’s role as a “springboard” for knowledge construction is thus crucial for a complete understanding of the history of radiology. (shrink)

This study provides a comparison of thinking style and ethical decision-making patterns between 386 U.S. students and 506 students from the People’s Republic of China enrolled in undergraduate business education in their respective countries. Contrary to our expectations, the Chinese students demonstrated a significantly greater linear thinking style compared to American students. As hypothesized, both Chinese and U.S. students possessing a balanced linear and nonlinear thinking style profile demonstrated greater ethical intent across a series of ethics vignettes. Chinese students also (...) were more likely to adopt an act utilitarian rationale, an ethical philosophy that in practice may violate government regulations or social rules to benefit one’s family instead of society for explaining their decisions across the vignettes. This paper seeks to establish the ethical foundation of MNCs' responsibility for providing host country workforce (HCW) preparation and training attendant to the new expatriate management assignment. It argues that such moral responsibility arises from a set of correlative duties which MNCs acquire as business institutions. They include duties involving the expatriate manager, the HCW, and the host nation to (1) assist all employees, including the expatriate manager, in the successful execution of their assignments; (2) avoid the semblance of discriminatory (...) treatment; (3) encourage full status integration into a global economy; (4) foster personal enlightenment and self-enrichment; (5) help individuals develop useful, marketable skills; (6) contribute to the development of a greater and more functional national labor skill base; and (7) encourage a long-term focus on creating enduring value for a maximum number of stakeholders, rather than upon short-term and shortsighted profit for only a few. We investigate and extend the notion of a good approximation with respect to the enumeration ${({\mathcal D}_{\rm e})}$ and singleton ${({\mathcal D}_{\rm s})}$ degrees. We refine two results by Griffith, on the inversion of the jump of sets with a good approximation, and we consider the relation between the double jump and index sets, in the context of enumeration reducibility. We study partial order embeddings ${\iota_s}$ and ${\hat{\iota}_s}$ of, respectively, ${{\mathcal D}_{\rm e}}$ and ${{\mathcal D}_{\rm T}}$ (the Turing degrees) into (...) ${{\mathcal D}_{\rm s}}$ , and we show that the image of ${{\mathcal D}_{\rm T}}$ under ${\hat{\iota}_s}$ is precisely the class of retraceable singleton degrees. We define the notion of a good enumeration, or singleton, degree to be the property of containing the set of good stages of some good approximation, and we show that ${\iota_s}$ preserves the latter, as also other naturally arising properties such as that of totality or of being ${\Gamma^0_n}$ , for ${\Gamma \in \{\Sigma,\Pi,\Delta\}}$ and n > 0. We prove that the good enumeration and singleton degrees are immune and that the good ${\Sigma^0_2}$ singleton degrees are hyperimmune. Self-interest theories hold that rationality requires one always to choose what is best for oneself. Where these theories differ is in their accounts of what is best for one. Hedonism is a typical self-interest theory, distinguished from other versions by the claim that what is best for one is what gives one the greatest net balance of pleasure over pain. Gómez-Lobo thinks that Socrates is a self-interest theorist: Socrates believes that “a choice is rational if and only if it is (...) a choice of what is best for the agent”. Gómez-Lobo also thinks that Socrates holds that “something is good for an agent if and only if it is morally right” ; this distinguishes his theory from hedonism and other self-interest theories. Finally, Gómez-Lobo thinks that Plato defends Socrates’ in arguing at Gorgias 506c5-507a3 that “a being is good if and only if it has the order proper to it”: follows from and other Socratic principles. These three claims constitute the “foundations” of Socratic ethics mentioned in Gómez-Lobo’s title. (shrink)

This paper investigates Kit Fine's account of the nature of material objects – the theory of embodiments.1 This theory is custom-fitted to an intuitive distinction between ‘timeless’ and ‘temporary’ parthood. It incorporates these notions by postulating two operations by which objects can be generated from their (immediate) parts. The operation of ‘rigid embodiment’ generates objects which have their immediate parts timelessly. In contrast, any product of the alternative operation, ‘variable embodiment’, has only temporary material parts. I shall argue that Fine's (...) operations of embodiment cannot account for what I call ‘nucleated wholes’ – objects which have both timeless and temporary immediate parts. As such, the theory of embodiment does not account for a significant class of material things. Having explained the problem, I consider four ways in which Fine's theory might be defended. None of these responses is entirely satisfactory. I conclude by highlighting two ways in which one might continue – either proceeding within Fine's ‘operationalist’ framework, or dropping this and developing an alternative framework. (shrink)

In recent years sense–datum theories have received much criticism, but there is one type of error frequently involved in the sense–datum concept which is in need of further consideration. This error consists in a category confusion of such a nature that what is properly regarded as perceptual mode is treated as though it were the attribute of a thing. The mode or manner of perception is mistakenly transferred to the sense–datum with results which a little careful reflection shows to be (...) absurd. In what follows a specific case of this error connected with the notion of phenomenal organization will be discussed. (shrink)

The summa of a distinguished philosopher's career, and full treatment of the temporal in philosophical terms, this volume shows us that by taking time seriously we can discover something essential to almost every question of human concern. Are we IN time? Charles Sherover asks, and in pursuing this question he considers time in conjunction with cognition, morality, action, physical nature, being, God, freedom, and politics. His essays, while drawing upon Royce, Heidegger, Kant, Leibniz, and even Hartshorne and Bergson, defy (...) categorization by method or school; instead, they reveal the diversity and divergence of thinking about time as well as the myriad features and values within the omnipresence of time and change. The volume begins with an overview of the history of thought on time and a clarification of some fundamental conceptual distinctions in temporal ideas. Sherover then offers a critique of Kant, the first thinker to recognize that all human experience has a temporal form. In a series of essays on metaphysics--a valuable corrective to the dominant metaphysical tradition of talking about being as if time does not matter--he pursues temporal responses to such problems as being, internal relations, individuation, mind, and free will. Finally, in essays on time, freedom, and the common good, Sherover argues that these three phenomena are intrinsically related to one another, the fulfillment of each involving the other two. Throughout, these essays brilliantly depict human life and thought thoroughly steeped in time and argue for the significance of the future for human activity. Portraying the openness of the future as the basis for purposiveness and freedom, knowledge and moral action, social life and religious hope, Sherover's work conveys a hopeful message of human finitude that nonetheless allows us a measure of control over events in our own time. Backdating of stock options is an example of an agency problem. It has emerged despite all the measures (i.e., new regulations and additional corporate governance mechanisms) aimed at addressing such problems? Beyond such negative controlling measures, a more positive empowering approach based on ethics may also be necessary. What ethical measures need to be taken to address the agency problem? What values and norms should guide the board of directors in protecting the shareholders' interests? To examine these issues, we first (...) discuss the role values and norms can play with respect to underlying corporate governance and the proper role of directors, such as transparency, accountability, integrity (which is reflected in proper mechanisms of checks and balances), and public responsibility. Second, we discuss various stakeholder approaches (e.g., government, directors, managers, and shareholders) by which conflicts of interest (i.e., the agency problem) can be addressed. Third, we assess the practice of backdating stock options, as an illustration of the agency problem, in terms of whether the practice is legally acceptable or ethically justifiable. Fourth, we proceed to an analysis of good corporate governance practice involving backdating options based on a series of ethical standards including: (1) trustworthiness; (2) utilitarianism; (3) justice; and (4) Kantianism. We conclude that while executive compensation schemes (e. g., stock options) were originally intended to help remedy the agency problem by tying together the interests of the executives and shareholders, these schemes may have actually become "part of the problem," and that the solution ultimately depends upon whether directors and executives accept that all of their actions must be based on a set of core ethical values. This paper examines one of the most potent contemporaneous criticisms of the German Enlightenment (circa 1790) as well as the lessons that can be learned from such criticism. Specifically, it examines Kant's famous essay, “An Answer to the Question: What is Enlightenment,” and Hamman's objection drawn mainly from his “Letter to Christian Jacob Kraus.” It further argues Hamann’s criticisms are foresighted, especially when read against the subsequent dark imperil history of the ‘West' as seen in post-colonial theory.
